If he will get punishment for killing, it will be later in story or at the end of story like Lelouch of Rebellion, Banana Fish, 91 days etc. OP: The more HP you lose the more stats you lose (not based on % health from what I saw), if you use the quadratic fog then the red fog put less penalty from what I saw.
